Welcome to TriedAndPicked. These Terms of Use (“Terms”) govern your use of the website at https://triedandpicked.com and any related pages, emails, videos, and content we publish (together, the “Site”). The Site is operated by BHJ E, LLC, a Utah limited liability company (“TriedAndPicked,” “we,” “us,” or “our”).

Please read these Terms carefully. They include a disclaimer of warranties, a limitation of our liability, and a choice of Utah law and courts.

1. Acceptance of These Terms

By accessing or using the Site, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Site.

2. Eligibility

The Site is intended for adults. By using the Site, you represent that you are at least 18 years old (or the age of majority where you live, if higher). The Site is not directed to children, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has given us personal information, please contact us at contact@triedandpicked.com so we can delete it.

3. Our Reviews Are Informational Opinion, Not Professional Advice

Our reviews, rankings, comparisons, guides, and videos reflect our own opinions and experiences at the time they were written or recorded. They are provided for general information and entertainment only.

  • No professional advice. Nothing on the Site is medical, health, nutritional, legal, financial, investment, tax, safety, or other professional advice. Always consult a qualified professional before making decisions that could affect your health, finances, or safety, and always follow the manufacturer’s instructions and warnings.
  • Your results may differ. Products change, prices change, and individual experiences vary. We do not guarantee that a product will perform for you the way it did for us, or that information on the Site is complete, current, or error-free.
  • Prices and availability. Prices, offers, and availability shown or described on the Site may be out of date. The retailer’s site at the time of purchase controls.
  • Our methods. You can read how we evaluate products on our How We Review page.

4. Affiliate Relationships

TriedAndPicked is reader-supported. Some links on the Site are affiliate links, which means we may earn a commission if you click a link and make a purchase, at no extra cost to you. Affiliate programs we participate in may include CJ (Commission Junction) and ClickBank, and may change over time. Commissions do not determine our opinions, but you should know they exist. We do not sell products. When you click a link to a retailer, merchant, or other third-party site, you leave the Site. Any purchase you make is a transaction between you and that retailer or merchant (or, for some products, the platform acting as reseller, such as ClickBank), not with us.

  • The third party is solely responsible for its products, pricing, payment processing, shipping, returns, refunds, warranties, customer service, and product safety.
  • We do not control, endorse, or assume responsibility for third-party sites, content, products, or privacy practices. Their own terms and privacy policies apply.
  • Questions or problems with an order should be directed to the retailer or merchant you bought from.

6. Intellectual Property and Permitted Use

The Site and its content, including text, reviews, photos, graphics, videos, logos, the TriedAndPicked name, page design, and the selection and arrangement of content, are owned by BHJ E, LLC or its licensors and are protected by copyright, trademark, and other laws. Third-party product names, logos, and trademarks belong to their respective owners and are used for identification only.

What you may do. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to view and use the Site for your own personal, non-commercial purposes. You may also share links to our pages and quote brief excerpts with clear attribution and a link back to the original page.

What you may not do without our prior written permission. Copy, republish, sell, license, modify, create derivative works from, frame, or otherwise commercially exploit any Site content, or remove any copyright or other proprietary notices.

All rights not expressly granted to you are reserved.

7. User Submissions and Comments

The Site does not currently accept comments, reviews, or other user submissions. If we add these features in the future, the following applies to anything you submit, post, or send to us, including comments, product suggestions, photos, emails, and feedback (“Submissions”):

  • You keep ownership of your Submissions, but you grant BHJ E, LLC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, display, edit, adapt, publish, and distribute them in connection with the Site and our business, in any media.
  • You are responsible for your Submissions. You confirm that you have the rights needed to submit them and that they do not violate any law or anyone else’s rights.
  • Be honest. If you have a material connection to a product or brand you comment on (for example, you work for the company or were paid or given a free product), you must disclose it.
  • Not allowed: content that is unlawful, defamatory, harassing, hateful, obscene, misleading, infringing, spam, or that contains personal information about others or malicious code.
  • Moderation. We may review, edit, refuse, or remove any Submission at any time, for any reason, but we have no obligation to monitor Submissions.
  • Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.

We respect the intellectual property rights of others and respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.

What your notice must include. To be effective, your written notice must include:

  1. Your physical or electronic signature (or that of a person authorized to act on behalf of the copyright owner);
  2. Identification of the copyrighted work you claim has been infringed (or a representative list, if several works are covered by one notice);
  3. Identification of the material you claim is infringing, with enough information for us to locate it (for example, the specific URL);
  4. Your contact information, including your name, mailing address, telephone number, and email address;
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.

Counter-notice. If material you posted was removed and you believe it was removed by mistake or misidentification, you may send our designated agent a counter-notice that includes: (1) your physical or electronic signature; (2) identification of the material removed and where it appeared before removal; (3) a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification; and (4) your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, any judicial district in which BHJ E, LLC may be found), and that you will accept service of process from the person who submitted the original notice or that person’s agent. We may restore the material in 10 to 14 business days after receiving a valid counter-notice unless the complaining party notifies us that it has filed a court action.

Repeat infringers. We may, in appropriate circumstances, disable or terminate access for users who repeatedly infringe the copyrights of others.

Please note that you may be liable for damages if you knowingly misrepresent that material is (or is not) infringing.

9. Prohibited Uses

You agree not to, and not to help anyone else to:

  • Scrape, crawl, spider, harvest, or extract content or data from the Site using bots, scripts, or other automated means, except for standard search-engine indexing that follows our robots.txt;
  • Use Site content to build a competing database, product, or service, or to train, fine-tune, or benchmark artificial intelligence or machine-learning models, without our written permission;
  • Copy, mirror, frame, or republish the Site or its content except as allowed in Section 6;
  • Interfere with, overload, or disrupt the Site or its security features, or attempt to bypass rate limits, access controls, or Cloudflare protections;
  • Probe, scan, or test the vulnerability of the Site, or attempt to gain unauthorized access to any system or data;
  • Upload or transmit viruses, malware, or other harmful code;
  • Generate fraudulent clicks, impressions, or traffic, or otherwise manipulate affiliate links or commissions;
  • Impersonate any person or misrepresent your affiliation with anyone, including us;
  • Use the Site in violation of any applicable law or regulation, or for any unlawful or fraudulent purpose.

We may suspend or block access to the Site for anyone we believe has violated these Terms.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BHJ E, LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Site will be uninterrupted, secure, or error-free, that content is accurate, complete, or current, or that any product we review will meet your needs. We make no warranties about any third-party product, service, retailer, or website. Any warranty for a product you buy comes only from its seller or manufacturer.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BHJ E, LLC OR ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, ITS CONTENT, THESE TERMS, OR ANY PRODUCT OR THIRD-PARTY SITE YOU LEARN ABOUT OR REACH THROUGH THE SITE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain warranty disclaimers or limitations of liability, so some of the above may not apply to you. In that case, our liability is limited to the smallest amount permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless BHJ E, LLC and its members, managers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use or misuse of the Site, (b) your Submissions, (c) your violation of these Terms, or (d) your violation of any law or the rights of any third party. We may assume the exclusive defense of any matter subject to indemnification by you, and you agree to cooperate with our defense.

13. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. You and BHJ E, LLC agree that any such dispute will be brought exclusively in the state or federal courts located in the State of Utah, and both parties consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum.

14. Changes to the Site and These Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms from time to time. When we do, we will post the updated Terms on this page and change the “Effective date” above. Changes take effect when posted unless we say otherwise. Your continued use of the Site after changes are posted means you accept the updated Terms.

15. Severability

If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

16. Entire Agreement and Other Terms

These Terms, together with our Privacy Policy and Affiliate Disclosure, are the entire agreement between you and BHJ E, LLC regarding the Site and supersede any prior agreements on that subject. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our consent; we may assign them, including in connection with a sale or transfer of the Site. Section headings are for convenience only. Sections that by their nature should survive termination (including Sections 6, 7, 10, 11, 12, and 13) will survive.
